1. Scope

These General Terms and Conditions (GTC) apply to all orders placed through our online store by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB).
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity (§ 14 BGB).

2. Contracting Partner, Conclusion of Contract

The presentation of products in the online store does not constitute a legally binding offer, but rather a non-binding invitation to order.

By clicking the order button, you submit a binding order. Confirmation of receipt is sent automatically via email and does not yet constitute acceptance of the contract.

The contract is only concluded when we accept your order by sending an order confirmation via email or by delivering the goods.

3. Customized Products

A large portion of our products are manufactured individually according to customer specifications.
Please check your details (print data, motifs, texts) carefully before submitting your order.

In accordance with § 312g para. 2 no. 1 BGB, there is no right of cancellation or return for goods manufactured to customer specifications or clearly tailored to personal needs.

4. Prices and Payment Methods

All prices are quoted in Euros and include statutory value-added tax (VAT).

Payments can be made via Shopify Payments (e.g., credit card, Klarna, Sofort, Apple Pay) as well as PayPal.
Payment is made in advance. Shipping takes place after receipt of payment.

5. Delivery and Shipping

Deliveries are made to the address specified by the customer. We deliver within Germany and to selected international countries. The available countries are displayed in the shop.

Depending on product size and order quantity, shipping is carried out by UPS, DHL, freight forwarders, or other suitable service providers.

Delivery times depend on the product and are specified in the shop. We will notify you separately of any delays regarding custom-made items.

6. Shipping Costs and Transfer of Risk

Shipping costs are indicated during the ordering process.

For consumers, the risk of accidental loss and accidental deterioration of the goods passes upon handover of the goods to the customer.
For entrepreneurs, the risk passes upon handover of the goods to the shipping company.

7. Retention of Title

The goods remain our property until full payment has been made.

8. Right of Cancellation

Excluded from the right of cancellation are personalized products or other cases excluded by law.

9. Warranty

The statutory warranty rights apply.

For printed products and custom-made items, production-related deviations (e.g., color, cutting) are possible and do not constitute a defect.

10. Liability

We are unlimitably liable for damages resulting from injury to life, body, or health, as well as in cases of intentional or grossly negligent behavior.

In the event of slightly negligent breach of essential contractual obligations (cardinal obligations), our liability is limited to the typical, foreseeable damage for this type of contract.

Otherwise, liability for simple negligence is excluded.

Liability under the Product Liability Act remains unaffected.

11. Responsibility for Content

Customers who submit or upload their own content (e.g., images, texts, logos, or print data) warrant that they own all copyright, trademark, or other usage rights required for this.

The customer indemnifies Advertising & Displays Werbecenter-Berlin GmbH against all claims by third parties that may arise from the unlawful use of this content.

We reserve the right to reject orders with unlawful, offensive, or discriminatory content.

12. Place of Jurisdiction and Applicable Law

German law applies to all contracts, excluding the UN Convention on Contracts for the International Sale of Goods.

If the customer is an entrepreneur, the exclusive place of jurisdiction is Berlin.
