1. Scope

These General Terms and Conditions (GTC) apply to all orders placed via our online shop by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity (§ 13 BGB).
An entrepreneur is a natural or legal person or a legally capable partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity (§ 14 BGB).

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By clicking the order button, you are placing a binding order. Confirmation of receipt will be sent automatically by email and does not yet constitute acceptance of the contract.

The contract only comes into effect when we accept your order by sending an order confirmation via email or by delivering the goods.

3. Customized products

A large proportion of our products are manufactured individually according to customer specifications.
Please check your details (print data, designs, texts) carefully before submitting your order.

According to § 312g para. 2 no. 1 BGB, there is no right of withdrawal or return for goods that are manufactured according to customer specifications or are clearly tailored to personal needs.

4. Prizes & Payment methods

All prices are quoted in euros and include VAT.

Payments are possible via Shopify Payments (e.g. credit card, Klarna, Sofort, Apple Pay) and PayPal.
Payment is required in advance. Shipping will take place after payment has been received.

5th delivery & Shipment

Deliveries are made to the address provided by the customer. We deliver within Germany and to selected international countries. The available countries are shown in the shop.

Depending on the product size and order quantity, shipping is handled by UPS, DHL, freight forwarders or other suitable service providers.

Delivery times vary depending on the product and are indicated in the shop. We will inform you separately of any delays with custom orders.

6. Shipping costs & Transfer of risk

Shipping costs are displayed during the ordering process.

For consumers, the risk of accidental loss or accidental damage to the goods passes to the customer upon delivery.
For businesses, the risk passes to the buyer upon handover of the goods to the shipping company.

7. Retention of title

The goods remain our property until full payment is received.

8. Right of withdrawal

Consumers have a statutory right of withdrawal, which can be viewed at the following link:

Personalized products or other cases excluded by law are excluded from the right of withdrawal.

9. Warranty

The statutory warranty rights apply.

For printed materials and custom-made products, deviations due to production processes (e.g., color, cut) are possible and are not considered defects.

10.Liability

We are liable without limitation for damages resulting from injury to life, body or health, as well as in cases of intentional or grossly negligent conduct.

In the case of slightly negligent breach of essential contractual obligations (cardinal obligations), our liability is limited to the typical, foreseeable damage.

Furthermore, liability for simple negligence is excluded.

Liability under the Product Liability Act remains unaffected.

11. Responsibility for content

Customers who submit or upload their own content (e.g. images, texts, logos or print data) assure that they possess all necessary copyright, trademark or other usage rights.

The client provides the advertising & Displays Werbecenter-Berlin GmbH is indemnified against all third-party claims that may arise from the unlawful use of this content.

We reserve the right to refuse orders containing illegal, offensive, or discriminatory content.

12. Place of jurisdiction & applicable law

All contracts are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods.

If the customer is an entrepreneur, the exclusive place of jurisdiction is Berlin.
