1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed via our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity (§ 13 BGB).
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity (§ 14 BGB).

2. Contractual Partner, Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.

By clicking the order button, you place a binding order. Confirmation of receipt is sent automatically by email and does not yet constitute acceptance of the contract.

The contract is only concluded when we accept your order by sending an order confirmation via email or by delivering the goods.

3. Individualized Products

A large proportion of our products are custom-made according to customer specifications.
Please check your details (print data, motifs, text) carefully before submitting your order.

In accordance with § 312g para. 2 no. 1 BGB, there is no right of withdrawal or return for goods that are manufactured according to customer specifications or clearly tailored to personal needs.

4. Prices & Payment Methods

All prices are quoted in Euro and include the statutory value-added tax (VAT).

Payments are possible via Shopify Payments (e.g., credit card, Klarna, Sofort, Apple Pay) as well as PayPal.
Payment is made in advance. Shipping takes place after receipt of payment.

5. Delivery & Shipping

Deliveries are made to the address specified by the customer. We deliver within Germany and to selected international countries. The available countries can be seen in the shop.

Depending on product size and order quantity, shipping is carried out by UPS, DHL, freight forwarders, or other suitable service providers.

Delivery times depend on the product and are specified in the shop. We will notify you separately of any delays in the case of custom-made products.

6. Shipping Costs & Transfer of Risk

Shipping costs are displayed during the ordering process.

For consumers, the risk of accidental loss and accidental deterioration of the goods passes to the customer upon handover.
For entrepreneurs, the transfer of risk occurs upon handover of the goods to the shipping company.

7. Retention of Title

The goods remain our property until full payment has been made.

8. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal, which can be viewed at the following link:

Personalized products or other legally excluded cases are excluded from the right of withdrawal.

9. Warranty

Statutory warranty rights apply.

In the case of printed products and custom-made items, production-related deviations (e.g., color, cut) are possible and do not constitute a defect.

10. Liability

We shall be liable without limitation for damages resulting from injury to life, body, or health, as well as in the event of intentional or grossly negligent behavior.

In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), our liability is limited to the foreseeable damage typical for the contract.

Otherwise, liability for simple negligence is excluded.

Liability under the Product Liability Act remains unaffected.

11. Responsibility for Content

Customers who submit or upload their own content (e.g., images, text, logos, or print data) warrant that they possess all necessary copyright, trademark, or other usage rights.

The customer indemnifies Advertising & Displays Werbecenter-Berlin GmbH against all claims by third parties arising from the unlawful use of this content.

We reserve the right to reject orders with unlawful, offensive, or discriminatory content.

12. Place of Jurisdiction & Applicable Law

German law applies to all contracts, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the customer is an entrepreneur, the exclusive place of jurisdiction is Berlin.

13. Online Dispute Resolution

The EU Commission provides a platform for extrajudicial online dispute resolution:

We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
